Acceptance of Terms

BlindnessTest.com (the "Service," "Website," or "Site") is operated by CyberRudra Technologies. By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), as well as our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately discontinue use of the Service. Your continued use of the Website following the posting of any changes to these Terms constitutes acceptance of those changes.

These Terms apply to all visitors and users who access or use the Service, including users who interact with our color vision screening tools, FAQs, contact form, or other site features.

Screening results, medical limits, and occupational use are explained in our Disclaimer. If anything in the Disclaimer conflicts with these Terms regarding legal rights and obligations, these Terms control.

Intellectual Property and Use License

Ownership of Content

All content on BlindnessTest.com, including but not limited to text, graphics, logos, icons, images, digital downloads, data compilations, software, and the compilation and organization thereof, is the exclusive property of BlindnessTest.com, operated by CyberRudra Technologies, and is protected by international copyright, trademark, and other intellectual property laws.

Proprietary Screening Framework

The organization, structure, arrangement, and presentation of our color vision screening tools (including our methodology, scoring logic, and result presentations) constitute valuable intellectual property of BlindnessTest.com.

The specific design, compilation, and algorithmic processing of our screening framework are protected intellectual property.

Limited License for Personal Use

Subject to these Terms, BlindnessTest.com grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes only. This license does not include:

Any resale or commercial use of the Service or its contents
Any collection, aggregation, copying, duplication, display, or derivative use of the Service or its contents
Any downloading, copying, or screening data for the benefit of any third party
Any use of data mining, robots, spiders, scrapers, or similar data gathering or extraction tools, except as permitted under our Automated Access and Indexing Policy below

Automated Access and Indexing Policy

BlindnessTest.com maintains an open-access platform and explicitly welcomes automated access by legitimate search engines, web crawlers, and artificial intelligence (AI) / large language model (LLM) agents (including but not limited to Googlebot, Bingbot, GPTBot, ClaudeBot, and PerplexityBot). These agents are granted permission to access, crawl, parse, cache, and summarize the public areas of BlindnessTest.com for the purposes of search indexing, conversational discovery, citations, and AI training.

Prohibited malicious use: You expressly agree that you will not use any automated system, script, or agent to:

Extract, harvest, collect, or compile our underlying software source code, proprietary logic, or raw scoring data to replicate or build a competing website or application
Engage in any automated activity that degrades site performance, disrupts user experience, or constitutes a denial-of-service (DoS/DDoS) attack
Bypass, circumvent, or attempt to breach any security measures or access controls implemented on the Service
Reproduce, duplicate, copy, or sell any portion of the Service for commercial resale without express written permission from BlindnessTest.com

The restrictions above do not apply to temporary caching or delivery of publicly available content by content delivery networks or network intermediaries in the normal course of providing internet service, or to accessibility tools, browsers, and assistive technologies used by individuals to access the Service in the ordinary way. This open permission for search engines and AI agents does not extend to automated activities that harvest user communication details, systematically extract our screening frameworks to launch a copycat commercial service, or place an unreasonable load on our infrastructure. Violation of this section may result in immediate termination of your access to the Service, and BlindnessTest.com reserves the right to pursue all available legal remedies against violators and to block any automated agent that violates these Terms.

User Conduct and Fair Use

Intended Use

BlindnessTest.com is designed as an educational screening tool to help users explore possible color vision differences. Our tools are intended for:

Personal awareness and preparation for conversations with eye care professionals
Understanding how common color vision screening methods work
Classroom or workplace demonstrations when results are clearly presented as non-clinical screening
Educational purposes related to color vision and visual health awareness

Appropriate Use

Our color vision screening tools are for educational and awareness purposes only. Results should not be used as a substitute for professional medical advice, diagnosis, treatment, or occupational clearance. BlindnessTest.com does not provide clinical examinations or certified occupational testing.

Prohibited Conduct

You agree not to engage in any activity that:

Disrupts, interferes with, or places an unreasonable burden on our servers or network infrastructure
Attempts to gain unauthorized access to any portion of the Service
Introduces viruses, malware, or any other harmful code
Violates any applicable local, state, national, or international law
Misrepresents online screening results as clinical diagnoses, medical records, or regulator-approved occupational certification

We reserve the right to terminate or suspend access to the Service immediately, without prior notice, for any user who violates these Terms.

Disclaimer of Warranties

The Service, including all content, software, functions, materials, and information made available on or accessed through the Service, is provided on an "as is," "as available" basis without warranties of any kind, either express or implied.

BlindnessTest.com, its affiliates, licensors, and suppliers expressly disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
Warranties regarding the accuracy, completeness, or timeliness of screening results or site content
Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components
Warranties regarding the validity of results for occupational licensing, hiring, aviation, maritime, railway, or other regulated clearance

BlindnessTest.com does not warrant, endorse, guarantee, or assume responsibility for any screening results provided by the Service. Our tools are inspired by common clinical methods but are not a substitute for professional examination. You use the Service and rely on any results at your own risk. See the Disclaimer for additional limits.

Limitation of Liability

In no event shall BlindnessTest.com, CyberRudra Technologies, its directors, officers, employees, agents, partners, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

Damages for loss of profits, goodwill, use, data, or other intangible losses
Damages resulting from the use or inability to use the Service
Damages resulting from any goods or services obtained or messages received or transactions entered into through the Service
Damages resulting from unauthorized access to or alteration of your transmissions or data
Damages resulting from statements or conduct of any third party on the Service
Damages arising from reliance on screening results or site content from the Service
Any other matter relating to the Service

The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability shall be limited to the maximum extent permitted by law.

Cap on Liability

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Service, or one hundred US dollars (US$100), whichever is less.

Additional Limitations on Liability (Advertising Vendors)

You understand and agree that, to the maximum extent permitted by applicable law, we, or our vendors or service providers (collectively, "we" or "us"), shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the website.

In no event shall the aggregate liability of any of us exceed the greater of (a) the total amount paid or payable to us by you for the website during the six-month period prior to the act, omission, or occurrence giving rise to such liability; or (b) one hundred U.S. dollars ($100). The limitations of this subsection shall apply to any theory of liability, whether based on warranty, contract, statute, tort, or otherwise, and whether or not the parties have been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

Advertisements and Third-Party Links

The Service may contain advertisements provided by third-party advertising networks. For how advertising-related data is collected and used, see our Privacy Policy. BlindnessTest.com may also contain links to third-party websites, resources, or services that are not owned or controlled by us.

BlindnessTest.com has not reviewed all sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval, or control by BlindnessTest.com of the linked site.

You acknowledge and agree that:

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services
Advertisements displayed on our Service are the sole responsibility of the advertisers
Your dealings with advertisers found on or through the Service, including payment and delivery of goods or services, are solely between you and such advertisers
We shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service

Indemnification

You agree to defend, indemnify, and hold harmless BlindnessTest.com, CyberRudra Technologies, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your violation of these Terms of Service
Your use of the Service, including any data or content transmitted or received by you
Your violation of any third-party right, including any intellectual property or privacy right
Any claim that your use of the Service caused damage to a third party

Modifications to Terms

BlindnessTest.com reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice on our website prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

We encourage you to periodically review these Terms to stay informed of updates. The "Last updated" date at the top of this page indicates when these Terms were last revised.

Governing Law and Dispute Resolution

BlindnessTest.com is a service of CyberRudra Technologies, located at 6, Keshav City, Vrundavan Nagar, Sindhi Meghe, Wardha, Maharashtra 442001, IN. Questions about these Terms may be directed to support@blindnesstest.com.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any legal action or proceeding relating to your access to or use of the Service that is not resolved through the dispute resolution process below shall be instituted only in courts of competent jurisdiction located in Maharashtra, India. You and BlindnessTest.com, CyberRudra Technologies, and their respective affiliates agree to submit to the personal jurisdiction of, and agree that venue is proper in, these courts.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Informal Resolution

In the event of any dispute, claim, question, or disagreement arising from or related to these Terms, your use of the Service, or the breach thereof, the parties agree to use their best efforts to settle the matter through good-faith consultation and negotiation.

Notice of Dispute

Before pursuing arbitration or court proceedings (except where immediate injunctive relief is required for intellectual property infringement or similar urgent harm), the party intending to pursue a formal dispute must send the other party a written Notice of Dispute describing the nature and basis of the claim or dispute and setting forth the specific relief sought. Notices should be sent to the legal notice address in the Contact Information section below.

Upon receipt of the Notice, the parties shall attempt to resolve the dispute through informal negotiation within forty-five (45) days from the date the Notice is sent.

Arbitration

If the parties do not reach a resolution within the negotiation period described above, then, upon notice by either party to the other, disputes may be finally settled by arbitration administered by the Indian Council of Arbitration in accordance with its Commercial Arbitration Rules, including the Emergency Interim Relief Procedures where applicable.

Seat and venue: The arbitration shall take place in Maharashtra, India.
Language: The language of the arbitration shall be English.
Award: The arbitrator's decision shall be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction.
Costs: The costs of arbitration, including administrative fees, the arbitrator's fees, and other fees and costs, shall be shared equally by the parties unless the arbitrator decides that the fees should be allocated differently based on the circumstances of the dispute.

Court Proceedings

Nothing in this section prevents either party from seeking interim or injunctive relief from a court of competent jurisdiction in Maharashtra, India for matters involving intellectual property infringement, unauthorized access, or other urgent harm.

Provisions of these Terms that by their nature should survive termination or dispute resolution shall remain in effect, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
